By accessing this Site entitled Check Your Spiritual Pathway via “http://www.check-your-spiritual-pathway.co.uk” and herein after known as “CYSP” within these Terms of Use you agree to hold CYSP harmless from any loss, claim or damage arising from your use of any of the information and ideas and advice and guidance and directions contained on the Site, including the following-on of suggestions or advice e-mailed to you.

Limitation of Liability

CYSP offers confidential advice and guidance and direction on your spiritual pathway to help you to overcome your life difficulties and where appropriate to confirm that your course of action is deemed to be the correct course of action for you to take during the relevant period.

You must be 18 years of age or older to request and purchase a reading from CYSP.

Spiritual Psychic Medium readings are not suitable, for persons suffering from clinical depression or other mental or emotional disorders, or for those in extreme circumstances.

Please be aware that readings can promote an emotional response.

The Site is for entertainment purposes and the material provided in and sent to you from CYSP is designed strictly for entertainment purposes only.

The information in this Site is provided with the understanding that CYSP is not engaged in rendering medical services or medical advice or medical diagnosis; psychological services or psychological advice or psychological diagnosis; taxation services or taxation advice; legal services or legal advice; investment services or investment advice; financial services or financial advice; accounting services or accounting advice; gambling/betting services or gambling/betting advice; and any information should not be construed as such. CYSP will not answer questions regarding such issues. If you feel the need for such services, please contact the appropriate professional person.

No guarantees of any sort are given regarding this Site and its services.

No refunds will be given when a reading has been commenced and or delivered to the person requesting the reading. Full refunds will only be given if CYSP has received payment from you but is unable to do your reading due to illness or other events beyond the control of CYSP.

All readings are personal and extremely specific to the person requesting the reading. You may not request readings on behalf of another person unless you can prove explicitly in writing that person’s desire to receive a reading. Every reading given is unique to you and the information given will not apply to anyone else.

CYSP will focus on you, for as long as needed, to directly address your chosen reading type - specifically and accurately.

CYSP sells a small amount of individually hand picked crystals as an optional service. The terms and conditions for purchasing crystals from CYSP are:

The Products

Crystals sold on this site are sourced from various retail outlets within the United Kingdom.The physical size of crystals sold by CYSP varies but as an indication most seem to be about the size of a small round or oblong pebble. The majority of crystals sold by CYSP have highly polished surfaces with, where applicable, smooth corners and edges. CYSP does not interfere with the physical manufacture of crystals. CYSP will boost the believed energies of each healing crystal it sells with Reiki and spiritual energies in an attempt to enhance the crystal's natural healing properties.

Crystals are not for human or animal or mammal or reptile or bird consumption and must not be placed in any human body or animal body or mammal body or reptile body or bird body orifice. If accidentally swallowed or imbedded within a body immediately seek urgent medical attention.

Shipment/Post/Mail

Product Shipment: For protection during shipping, all crystals are securely packaged and addressed with both the purchaser’s mailing address and the mailing address of CYSP, stamped with the correct postage and insured accordingly. For overseas purchasers and where appropriate a Customs Declaration will be attached to the package.

Shipping/Postal Tracking: The “on-line” Royal Mail Tracking System is used to track the whereabouts of items dispatched by CYSP.

Basis of the Sale

These Conditions shall apply to the Contract and govern the Contract to the exclusion of any other terms and conditions which the purchaser may purport to apply under any purchase order, confirmation of order or similar document. All communications including advertisements made by CYSP and all information on this web site are invitations to treat only and are not offers or unilateral contracts. Your submission of an order represents an offer to purchase the product(s) indicated by you, and is not binding on CYSP until CYSP have notified you that the order is accepted. This means that if a Crystal product is shown on the web site but is not available or is incorrectly priced or otherwise incorrectly described, CYSP shall not be obliged to sell you that crystal product. CYSP cannot accept orders from persons under 18 years of age; please do not place an order with us if you are under 18 years of age. We will be pleased to take an order from your parent/guardian. All orders for crystal product(s) shall be deemed to be an offer by the purchaser to purchase Crystal Product(s) pursuant to these conditions. No variation to these Conditions shall be binding unless agreed in Writing by CYSP. In entering into the Contract the Purchaser acknowledges that it does not rely on, and waives any claim for breach of, any such representations, which are not so confirmed. Any typographical, clerical or other error or omission in any quotation, price list, acceptance of offer, invoice or other document or information unused by CYSP shall be subject to correction without any liability on the part of CYSP.

Commissions

Where the Purchaser wishes to commission CYSP to find or source a particular or specified crystal product to the purchaser’s requirements no order submitted by the Purchaser shall be deemed to be accepted by CYSP unless and until confirmed in Writing by CYSP.

Price of the Product(s).

All prices quoted are in Great Britain Pounds (GBP). The price of crystals shall be the price shown on this web site or set out in writing by CYSP following an enquiry made by the purchaser. Except as otherwise stated under the terms of any quotation or in any price list of CYSP, all prices are given by CYSP on the basis of delivery to the purchaser at CYSP’s premises, the Customer shall be liable to pay CYSP’s charges for shipping, packaging and insurance (“Shipping costs”). Price is free of any applicable value added tax (VAT), as CYSP is neither liable nor registered for VAT.

Discounts may be levied for multiple orders, commissions and purchases at the sole discretion of CYSP and must be confirmed in writing by CYSP. In all cases discounts do not apply to the shipping/postal/delivery/insurance costs.

Terms of Payment

Payment may be made securely by Credit Card via PayPal or by personal cheque drawn on a British Clearing Bank or by Bankers Draft drawn on a British Clearing Bank or by UK postal Order drawn on British Post Office domiciled within the geographic territory of the United Kingdom or in cash providing that any cash payment is made in person. CYSP does not accept cash sent through the post whether registered or otherwise and assumes absolutely no responsibility should any such cash remittance be lost in the postal networks whether with the United Kingdom or elsewhere. In the case of foreign currency transactions, all foreign exchange charges and commissions are for the customer’s account. Similarly, all foreign taxes, border fees and foreign exchange controls are for the customer’s account. Purchasers outside of the United Kingdom are responsible for paying any foreign exchange charges, commissions and taxes and any bank charges from their own bank or from their bank’s correspondent network. Purchaser(s) shall pay the price of the crystal product(s) together with any shipping and insurance costs prior to the despatch of the crystal product(s). Edward McNaught-Davis (CYSP) is PayPal verified. Payment made through PayPal is secure and CYSP will not be made privy to your banking or credit card details. PayPal can handle on behalf of CYSP payments via American Express, Mastercard, Switch, Solo, Visa, Visa Electron and Delta. Payment may be made in Great British Pounds (GBP) or US Dollars (USD) or Euros or Canadian Dollars (CAND) or Australian Dollars (AUZD) or Japanese Yen (JAPY). If payment by cheque is accepted that acceptance is conditional upon payment in full on first presentation. The time of payment shall be the essence of the Contract. If the Customer fails to make any payment by an agreed due date then, without prejudice to any other right or remedy available to CYSP, CYSP shall be entitled to cancel the contract.

Receipts of purchase

Where payment has been made via PayPal receipts of purchase are automatically generated by the PayPal system. Where payment has been made by other acceptable means a receipt of purchase will be sent within the postal package.

Delivery

Delivery of the Product(s) shall be made to the Customer by secured delivery as arranged by the British Postal Authority (Royal Mail). On receipt of cleared payment you will receive your crystal product(s) within 15 working days (UK Only). Upon receipt of your crystal product purchase, you are well advised to handle it carefully and to inspect it to determine whether you are satisfied to keep it. Please make sure your hands are clean and dry before removing the product(s) from its protective shipping package. Where you have ordered a crystal product that is currently out of stock, your order will be dispatched as soon as the ordered crystal product becomes available. CYSP will e-mail you to let you know when your order has been dispatched. Delivery will be within 5 working days from the date of the e-mail (UK Only).

Returns and Refunds

You have seven (7) calendar days in which to evaluate your crystal product purchase. Refunds will be given if the crystal product(s) received is not satisfactory to you and is returned in the same condition as shipped within seven days of receipt. Refunds cannot be given if the product is damaged by any means including but not limited to chips, however slight, moisture or dirt smudges, dents, cracks. Any returns must include the crystal product and its original packaging. Shipping, postal, insurance and bank charges will not be refunded.

Warranties and liability

Except in respect of death or personal injury caused by CYSP’s negligence, CYSP shall not be liable to the purchaser by reason of any representation or any implied warranty, condition or other term or any duty at common law or under the express terms of the Contract, for any consequential loss or damage (whether for loss or profit or otherwise howsoever), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of CYSP, its employees or agents or otherwise) which arise out of or in connection with the supply of the crystal product(s) or their use or resale by the purchaser, except as expressly provided in these Conditions. No specific or explicit warranties will be mentioned with each product for sale.

Legal Disclaimer

While every effort will be made to offer accurate past, present and future predicted information based on Spiritual Mediumship and or Clairvoyance and or Clairsentience and or Clairaudience and or Claircognisance and or Psychic prediction and or by utilising Dowsing techniques, errors can occur. CYSP hereby disclaim all warranties and conditions with regard to this information, products and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. CYSP shall not be responsible for any transfer delays beyond the control of CYSP including but not limited to email networking problems, Internet technical difficulties, software and hardware faults, postal delays and postal disputes and any illness of Edward McNaught-Davis.

Personal and Non-Commercial Use Limitation
CYSP is for your personal and non-commercial use. The information, contents, text, images, including but not limited to html code, scripts, reproductions as pencil or ink drawings or paintings and photography is the property of CYSP otherwise acknowledged and may not be copied, reproduced, republished, modified, displayed, performed, posted, transmitted, distributed in any way, create derivative works from, transfer or sell any information, without express, advance, written consent from CYSP. These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales within the United Kingdom. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales. You hereby consent to the exclusive jurisdiction and venue of courts in England and Wales within the United Kingdom in all disputes arising out of or relating to the use of this Site. Use of this Site is unauthorised in any jurisdiction that does not give effect to all provisions of these Terms of Use, including without limitation this paragraph.

CYSP is owned and operated by Edward McNaught-Davis. CYSP is operated as a for-profit trading enterprise, managed by Edward McNaught-Davis, in order to make a financial return.

You agree that no joint venture; partnership, employment, or agency relationship exists between you and CYSP as a result of this agreement or use of this Site.

These Terms of Use constitute the entire agreement between the user and CYSP with respect to this Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and CYSP with respect to this Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Fictitious names of companies, products, people, characters and/or data that may be used on CYSP for illustrative purposes are not intended to represent any real individual, company, product or event.
